1. Services & Booking
TJ Legacy provides for-hire passenger transportation including daycare, school, airport, medical, personal, and special-trip rides in the Milwaukee, WI and Chicago, IL areas and surrounding communities. Bookings may be made by phone, text, email, or our online booking/agreement form. A booking is confirmed only when we acknowledge it and any required deposit is received. We prefer at least 24 hours’ notice; same-day requests are accommodated when possible.
2. Licensing & Regulatory Compliance
- We operate as a passenger motor carrier and maintain the operating authority and registrations required by the Wisconsin Department of Transportation (WisDOT) under Wis. Stat. ch. 194.
- For trips within Illinois, we maintain authority as required by the Illinois Commerce Commission (ICC) under the Illinois Motor Carrier of Property/Passengers Law (625 ILCS 5/18c).
- For interstate trips (e.g., Wisconsin to Illinois, airport runs), we maintain USDOT/MC operating authority and comply with the Federal Motor Carrier Safety Administration (FMCSA) regulations (49 C.F.R. Parts 350–399).
3. Drivers, Safety & Vehicles
- Drivers are properly licensed for the vehicle operated, including a Commercial Driver License (CDL) with passenger (P) endorsement where required by capacity (Wis. Stat. § 343.04; 49 C.F.R. Part 383), and are subject to FMCSA drug & alcohol testing (49 C.F.R. Part 382) and Hours-of-Service limits (49 C.F.R. Part 395) where applicable.
- Vehicles are maintained and inspected under the Federal Motor Carrier Safety Regulations (49 C.F.R. Parts 392, 393, 396) and Wisconsin/Illinois inspection requirements.
- All passengers must wear seat belts where equipped (Wis. Stat. § 347.48; 625 ILCS 5/12-603.1). Children must be secured in an appropriate child safety/booster seat as required by Wis. Stat. § 347.48(4) and 625 ILCS 25/4; the Client is responsible for providing required child restraints unless arranged in advance.
- Stated passenger capacity may not be exceeded for any reason.
4. Insurance & Financial Responsibility
We carry commercial passenger liability insurance meeting or exceeding the minimums required by 49 C.F.R. Part 387, Wis. Stat. § 194.41, and applicable Illinois law. Certificates of insurance are available on request.
5. Passenger Conduct & Prohibited Items
- No smoking, vaping, or illegal drugs in any vehicle.
- Alcohol is permitted only for passengers of legal age (21+) and only with prior written approval; open-intoxicant laws (Wis. Stat. § 346.935; 625 ILCS 5/11-502) are observed.
- No weapons, hazardous materials, or unlawful activity. Conduct that endangers the driver, passengers, or vehicle may result in immediate termination of the trip without refund.
- Excessive cleaning or damage caused by a passenger will be billed to the Client.
6. Pricing, Deposits & Payment
- Rates are quoted per trip and may vary by distance, time, vehicle, and demand. Prices may vary; quotes are estimates until confirmed.
- A non-refundable deposit of 25% of the trip total is due at booking to reserve service; the balance is due before the trip begins unless otherwise agreed.
- Applicable taxes, tolls, parking, airport fees, wait time, and gratuity may apply. Overtime/wait time is billed in 30-minute increments.
7. Cancellations & Refunds
Cancellations and refunds are governed by our Cancellation & Refund Policy, which is incorporated into these Terms.
8. Delays, Force Majeure & Routing
Schedules are estimates. We are not liable for delays or failures caused by weather, traffic, road or airport conditions, mechanical issues, acts of God, or other events beyond our reasonable control. The driver has final authority over routing, stops, and safety-related decisions.
9. Limitation of Liability
We are not responsible for personal property left in a vehicle. To the maximum extent permitted by law, our total liability for any claim arising from a trip is limited to the amount paid for that trip. Nothing in these Terms limits liability that cannot be limited under applicable law.
10. Indemnification
The Client agrees to indemnify and hold harmless TJ Legacy from claims, damages, and costs arising out of the Client’s or its passengers’ acts, omissions, or breach of these Terms.
11. Non-Discrimination & Accessibility
We serve all riders and comply with the Americans with Disabilities Act (ADA) and Title VI of the Civil Rights Act. See our Accessibility Statement.
12. Electronic Communications & Signatures
You consent to transact and sign electronically. Electronic signatures and records are legally binding under the federal E-SIGN Act (15 U.S.C. § 7001), the Wisconsin Uniform Electronic Transactions Act (Wis. Stat. ch. 137), and the Illinois Uniform Electronic Transactions Act (5 ILCS 175). By providing your number you consent to receive booking-related calls and texts; message/data rates may apply and you may opt out at any time.
13. Governing Law & Disputes
These Terms are governed by the laws of the State of Wisconsin, without regard to conflict-of-law rules. The parties will attempt to resolve disputes informally first; unresolved disputes are subject to the courts of the county of TJ Legacy’s principal place of business, except where another venue is required by law.
14. Changes to These Terms
We may update these Terms from time to time. The version in effect at the time of your booking applies to that booking. Material changes will be posted on this page with a new effective date.
